Legal Considerations for Riverside County Inmate Deaths

Thousands of inmates die in-custody every year in the United States. According to Health Affairs, “On average, about 1.40 deaths occurred annually per 1,000 incarcerated people. About 0.62 deaths per 1,000 incarcerated people were illness-related deaths, 0.53 were suicides, and 0.15 were acute drug- or alcohol-related deaths. Accidents or homicides were less common (0.03 deaths each).” There are a number of common causes of inmate death.

  • Drug overdoses
  • Homicides
  • Suicides
  • Cancer

Inmate deaths are often highly preventable in a jail setting. Many involve the use of excessive force. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. There are a number of ways that law enforcement could cause an in-custody death.

  • Correctional officers may have caused an inmate to suffer positional asphyxia.
  • Correctional officers may have misused or abused tasers and pepper spray.
  • Correctional officers may have failed to get an inmate the medical care that they need.

Jail deaths are often complex events. They tend not to be the results of the wrongful actions of a single person. It is more common that they are the result of systemic failures within a jail system. Sadly, though, jails will often do everything in their power to deny responsibility when someone in their care dies. This is why it is so important that all in-custody deaths are properly reviewed by a skilled attorney.
