Legal Considerations for Los Angeles County Inmate Deaths
The Men’s Central Jail in Los Angeles has a terrible track record when it comes to inmate deaths. According to the Vera Institute of Justice, “Fifty-two people have died in Los Angeles County jails since the start of 2023. The overwhelming majority of deaths have occurred in the notorious Men’s Central Jail (MCJ), which has been slated to close for years, yet remains open.” There are a number of common causes of inmate death.
- Cancer
- Heart attacks
- Homicide
- Suicide
Inmates are not able to seek medical treatment the same way that a free person would. They are entirely dependent on jails to provide them with their daily needs, including medical care. When a jail is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a constitutional claim. There are several ways that an inmate may have contributed to the death of an inmate in medical distress.
- Many inmates die from not being given adequate treatment for a drug overdose.
- Drug or alcohol withdrawal can also be deadly. Inmates at risk of withdrawal should undergo medical detoxification under the supervision of a licensed physician.
- A number of inmates have died because they did not receive the medications they were already taken before being incarcerated.
Jail deaths are often highly preventable. They tend to be the results of jail officials failing to follow safety protocols. For example, inmates should be given routine wellness checks during their stay. Inmates with certain medical conditions may need closer observation. The family of any inmate who died in custody may be able to seek some measure of accountability through a civil claim.
