Liability For Los Angeles County Inmate Deaths
Los Angeles County has one of the highest instances of inmate deaths across California. According to LAist, “UCLA researchers analyzed the autopsies of people who died in L.A. County jails over 10 years, and found that more than half of deaths classified as “natural” had evidence of physical harm on the bodies.” There are a number of common causes of inmate deaths.
- Cancer
- Suicide
- Homicide
- Drug overdoses
Jails have a legal obligation to provide inmates with reasonably adequate care for all of their medical conditions. This should begin when an inmate is first admitted. Jails should give all inmates in their care a thorough health screening. Some inmates may only need very minor care. Other inmates may need treatment for chronic health conditions. There are a number of ways that a jail may have failed to properly care for an inmate.
- Jails may have failed to allow an inmate to see a doctor.
- Jails may have failed to help an inmate going through an overdose.
- Jails may have failed to help an inmate at risk of self-harm.
When a jail is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a constitutional claim. It is also possible that a private healthcare provider could be liable for the death of an inmate. Jails often outsource health services to private corporations. These companies tend to be more concerned with making money than providing adequate care.
