DELANO, CALIFORNIA (May 20, 2024) – A 32-year-old inmate has tragically died while in custody at the Kern Valley State Prison in Delano.

Kern County officials are saying that the incident took place on Wednesday. Correctional officers noticed that one inmate was in medical distress.

Jail staff and medical staff began life-saving measures in order to save the man. But those efforts to save him were not successful.

Kern County officials are planning on releasing the name of the victim once his next of kin has been notified.

Liability For Kern County Inmate Deaths

Thousands of inmates die from drug overdoses each year. Many of these deaths involve fentanyl. According to the National Institute of Drug Abuse, “Fentanyl is a powerful synthetic opioid that is similar to morphine but is 50 to 100 times more potent. It is a prescription drug that is also made and used illegally. Like morphine, it is a medicine that is typically used to treat patients with severe pain, especially after surgery.” There are a number of signs that an inmate is going through a drug overdose.

  • Severe drowsiness
  • Shallow breathing
  • Cold, clammy skin
  • Pinpoint pupils

Jail officials have a legal obligation to help all inmates with their medical needs. This includes help in the event of a drug overdose. In many situations, jail officials may cause an overdose through their own negligence. For example, a nurse may have given an inmate too much fentanyl during a medical procedure. It is important that evidence is properly preserved after any inmate’s death.

  • Medical records should be collected.
  • An independent autopsy should be performed.
  • Surveillance footage should be sought.
  • The cause of the death should be determined.

Jails can be very dangerous places, even in the best of circumstances. Part of the problem is that jails tend to rotate staff in and out on a regular basis. This leads to a situation where the correctional officers stationed there are never particularly well trained. It is important that inmates and their families understand their rights. The family of any inmate who died in custody may have legal recourse through a civil claim.
