RIVERSIDE COUNTY, CALIFORNIA (September 17, 2024) – A man was critically injured in a Riverside County police shooting with an off-duty officer near Murrieta Hot Springs Road.

Riverside County officials are saying that the incident took place around 9:15 a.m. in a parking lot. Initial reports suggest that there may have been some type of road rage incident.

This led to a shooting with an off-duty police officer from Hemet. Paramedics were called to the scene in order to help the man who was shot.

He was rushed to a nearby hospital with critical injuries. A full investigation remains ongoing at this time.

Liability For Riverside County Police Shootings

Police shootings remain alarmingly common across the United States and California. According to the Public Policy Institute of California, “About 195 people die each year from interactions with California law enforcement. Gunshots are by far the most common cause of death: nearly 250 people are shot by police each year.” There are a number of measures that police officers should take in order to prevent police shootings.

  • Police officers should be trained to de-escalate encounters.
  • Police officers should use non-lethal measures first in most situations.
  • Police officers should determine if a suspect may be suffering from a mental illness.

Depending on the facts of any case, a police department could be liable for any incident where a suspect is injured in a police shooting. This may even be the case if the officer involved was off-duty at the time of the shooting. An officer may have displayed their badge or brandished a firearm and said that they are a cop. Consider, for example, Pena v. Deprisco. A federal appeals court found that a police officer’s and supervisors encouragement and “active facilitation” of an off-duty officer’s drunk driving constituted a “state created danger.” It is important that evidence is properly preserved after any police shooting.

  • Surveillance footage should be sought.
  • Eye witnesses should be interviewed.
  • Medical records related to the incident should be collected.

It can be hard to know where to begin after being injured in a police shooting. Victims often suffer life-altering injuries. This can impact their ability to be gainfully employed. To make matters worse, police departments will often do everything in their power to deny responsibility when their officers shoot someone. It is crucial that victims understand their rights. They may be able to file a civil claim through 42 U.S. Code § 1983.
