Santa Clara County officials are saying that the incident took place around 10:30 a.m. on Thursday. Correctional officers noticed that a 41-year-old inmate was unresponsive in his cell.

Medical staff entered the cell and began life-saving measures. Sadly, the inmate was pronounced dead about 20 minutes after being discovered.

A full investigation remains ongoing at this time.

Liability For Inmate Deaths At Elmwood Correctional Facility

Far too many inmates die in custody each year in California. According to Axios, “In California, the death rate was 40.2 for every 10,000 inmates in 2020 — up 27% from 2019, according to the Marshall Project’s analysis of a study published in Science Advances.” There are many common causes of inmate death.

  • Homicide
  • Suicide
  • Drug overdoses
  • Heart attacks

Jails must take reasonable measures in order to protect all of the inmates in their care. This includes protecting inmates from acute and chronic health conditions. Inmates are more likely than the general public to suffer from serious health conditions before they enter the prison system. Jails should take a number of measures in order to prevent inmate deaths.

  • Jail staff should be trained to recognize when an inmate is in medical distress.
  • Jails should make sure that they work closely with medical professionals.
  • Jails should seek to understand why every death in their care takes place.

Jails can be extremely difficult places to live, even in the best of circumstances. Many of these deaths are entirely preventable. This is particularly true when an inmate’s death is listed as “natural.” The fact of the matter is that many inmate deaths listed as natural involved some amount of medical neglect. The family of any person who died in custody may have legal recourse through a civil claim.
