San Jose – A man died while in custody of the San Jose Police Department after being detained on October 22, 2025, in a residential disturbance call. His identity has not yet been formally released.
Incident Overview
At approximately 8:05 a.m., officers responded to a home in the 400 block of South Buena Vista Avenue in San Jose for a reported physical confrontation. As officers made their way to the home, they received another report that said a man was suffering from a drug overdose. Upon arrival, officers encountered a man they said was naked and erratic. The individual was detained and placed into custody, but minutes later he began experiencing a medical emergency. Officers called for paramedics and began life-saving efforts before taking the man to a local hospital, where he was pronounced dead.
The Santa Clara County District Attorney’s Office and the San Jose Police Department’s Homicide Unit are both investigating the incident.
Legal Oversight
Given the nature of this in-custody death, several procedural and legal mechanisms will be engaged:
- Under the Fourteenth Amendment, detainees have protections against “deliberate indifference” to serious medical needs. If authorities fail in monitoring or responding properly, legal claims may follow.
- If misconduct or negligence is revealed, civil rights claims under 42 U.S.C. § 1983 may be available.
