Legal Oversight & Use-of-Force Standards
Under California law, the use of deadly force by peace officers is governed by California Penal Code § 835a — allowing officers to discharge firearms only when they reasonably believe it is necessary to prevent imminent death or serious bodily injury.
In reviewing this incident, investigators will examine whether:
- The suspect posed an imminent threat to officers or others;
- The fleeing suspect or conduct during the traffic stop justified the use of lethal force;
- Any less-lethal alternatives or de-escalation tactics were feasible under the circumstances;
- Departmental policies, training, and protocols were properly followed.
If the force is determined to be unjustified or excessive, the circumstances may support civil-rights or wrongful-death claims under 42 U.S.C. § 1983.
