Liability For Los Angeles County Police Officials

Thousands of people are seriously injured or killed every year in the United States. According to Statista, “ Between 2013 and 2023, over 1,000 people have been killed by police in every year. Some of the most infamous examples include the murder of George Floyd in May 2020, and the shooting of Breonna Taylor earlier that year.” Police departments should take a number of measures in order to prevent police shootings.

  • Police officers should be trained to de-escalate encounters.
  • Police officers should have less-lethal options, such as tasers.
  • Police officers should understand when a suspect may be in the midst of a mental health crisis.

Police officers must do everything in their power to avoid needlessly harming suspects. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. It is important that evidence is properly preserved after any police shooting.

  • Eyewitnesses should be interviewed.
  • Body camera footage from all officers involved should be sought.
  • A thorough investigation should be conducted.
  • The actions of the officers leading up to the shooting should be understood.

It can be hard to know where to begin after a police shooting. These incidents often involve suspects who are struggling with serious mental illnesses. To make matters worse, police departments will do everything in their power to deny responsibility if one of their officers injures a suspect. Any person who is injured due to the excessive force of police officers may be able to seek some measure of accountability through a civil claim.
