Investigation Underway After Anaheim Police Officers Shoot Suspect Holding Fake Gun
ANAHEIM, CALIFORNIA (December 31, 2024) – A man has tragically died in an Anaheim police shooting near a home near the intersection of South Maywood Street and South Street.
Orange County officials are saying that the incident took place around 8:00 p.m. on Friday. Police officers were called after getting reports of a possible robbery.
When officers arrived at the scene, they encountered a suspect. He was allegedly in possession of a fake firearm prior to being shot by police.
Paramedics were called to the scene in order to help the man. He was taken to the hospital, where he was later pronounced dead.
Legal Considerations for Anaheim Police Shootings
Police shootings remain all too common in the United States. According to one study in the American Public Health Association, “We identified 1552 police homicides in the 16 states. Positive predictive value and sensitivity of the NVDRS “type of death” variable for police homicides were high (98% and 90%, respectively).” Police officers should take a number of measures in order to avoid shootings.
- Police officers should work to de-escalate encounters.
- Police officers should wait for backup in high-risk situations.
- Police officers should be trained to recognize when a suspect is in the midst of a mental health crisis.
Police officers have a legal obligation to use the least amount of force necessary for any given situation. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. It is critically important that certain steps are taken after any police shooting.
- Body camera footage from all officers involved should be reviewed.
- The actions of police officers leading up to the shooting should be understood.
- An experienced civil rights attorney should be contacted.
Police shootings are often highly preventable. They tend to involve situations where officers are either unwilling or unable to de-escalate encounters. In many cases, officers are simply poorly trained to deal with people who are in the midst of a mental health crisis or on drugs. They may quickly resort to using violence when this is not needed. The family of any person killed in a police shooting may have legal recourse through a wrongful death claim.
