Investigation Underway After Man Injured In Fresno Police Shooting Near Grant Avenue and Seventh Street
FRESNO, CALIFORNIA (August 24, 2024) – A man was injured in a Fresno police shooting at a home near the intersection of Grant Avenue and Seventh Street.
Fresno County officials are saying that the incident took place around 2:55 p.m. on Tuesday. The CHP was investigating reports of a stolen truck when they found a man sitting in the driver’s seat.
When officers tried to talk to the man, he put his vehicle in reverse and hit an unmarked patrol vehicle. The officers opened fire and struck the man in the upper torso.
Paramedics were called to the scene in order to help the man. He was taken to a local hospital in critical condition.
A full investigation remains ongoing at this time.
Liability For Fresno County Police Shootings
Police shootings remain all too common in the United States and California. According to the Public Policy Institute of California, “About 195 people die each year from interactions with California law enforcement. Gunshots are by far the most common cause of death: nearly 250 people are shot by police each year.” Police officers should take a number of measures in order to prevent police shootings.
- Police officers should work to de-escalate encounters.
- Police officers should be equipped with less-lethal options.
- Police officers should wait for backup in high-risk situations.
Police officers are allowed a great deal of leeway in how they perform their job duties. But at no point are officers permitted to use excessive force. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. It is important that certain steps be taken after any police shooting.
- Eyewitnesses should be interviewed.
- Body camera footage from officers involved should be sought.
- The actions of officers leading up to the shooting should be understood.
Police shootings are often highly preventable. They tend to involve situations where officers fail to properly de-escalate encounters. An officer’s “failure to follow a safety rule promulgated by his employer, regardless of its substance, serves as evidence of negligence.” See, for example, Grudt, 468 P.2d at 831 (citation omitted); see People v. Brown, 245 Cal. App. 4th 140, 171 (Ct. App. 2016). Any person injured in a police shooting may be able to seek some measure of justice through a civil claim.
