Legal Considerations For Los Angeles County Nursing Home Deaths

Abuse and violence at assisted living facilities remain all too common. According to the World Health Organization, “Around 1 in 6 people 60 years and older experienced some form of abuse in community settings during the past year. Rates of abuse of older people are high in institutions such as nursing homes and long-term care facilities, with 2 in 3 staff reporting that they have committed abuse in the past year.” Nursing homes should take a number of measures in order to prevent abuse and violence at nursing homes.

  • Nursing home staff should be taught to recognize signs of abuse.
  • Nursing homes should work to help residents manage their conflicts peacefully.
  • Nursing homes should have clear policies and reporting mechanisms.

Nursing homes have a legal obligation to protect residents from reasonably foreseeable sources of harm. This includes protecting residents from violence at the hands of other residents. When a nursing home recognizes that a staff member or resident poses an unreasonable risk of harm, they must take action. Failing to take action to protect residents could form the basis of a negligence claim. It is important that certain steps are taken after any attack at a nursing home.

  • A police report of the incident should be created.
  • Eyewitnesses should be interviewed.
  • Medical records related to the incident should be collected.
  • An experienced personal injury attorney should be contacted.

Nursing homes are supposed to do everything in their power to provide a safe environment for residents. But far too often this does not take place. It is important for victims of violence at nursing homes to understand that they do have rights. This is also true of the family of any person killed in a nursing home facility. They are able to seek some measure of justice and accountability through a civil claim.
