When officers arrived at the scene, they encountered the man. He allegedly approached officers before being shot by them.
Paramedics were called to the scene in order to help the man. Sadly, he later died due to his injuries.
Legal Considerations For Banning Police Shootings
Police shootings remain all too common in the United States. According to the Law Enforcement Epidemiology Project, “In the U.S. during a given year, an estimated 1 million civilians experience police threat of or use of force resulting in a conservative estimate of 75,000 non-fatal injuries requiring hospital treatment and 600-1000 deaths.” Police departments should take a number of actions in order to avoid needlessly harming suspects.
- Police officers should be trained to understand when a suspect is going through a mental health crisis.
- Police departments should equip their officers with less lethal measures.
- Police officers should avoid using threats against suspects in distress.
Police officers must always use the least amount of force necessary for any given situation. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law, or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution shall be liable to the injured party in an action at law. There are several ways that a police officer may have used excessive force.
- Police officers may have shot a suspect merely because they were attempting to flee.
- Police officers may have hit a suspect who was already restrained.
- Police officers may have caused a suspect to sustain positional asphyxia.
It can be hard to know what to do after any police shooting. Police departments will often do everything in their power to deny responsibility when their officers kill someone. This is why it is so important that evidence is properly preserved after any fatal shooting. The family of any person who died in a police shooting may have legal recourse through a civil claim.
