Legal Considerations for Del Norte County Police Shootings

Thousands of people are seriously injured or killed in encounters with law-enforcement every year. According to the Law Enforcement Epidemiology Project, “Of the estimated 250,000 civilians injured each year by law enforcement, approximately 75,000 suffer a non-fatal injury requiring hospital treatment.” There are a number of factors that may contribute to a shooting.

  • Police shootings are more likely when a suspect is in the midst of a mental health crisis.
  • Police shootings are more likely when officers are poorly trained.
  • Police shootings are more likely at night when officers are not able to clearly see suspects.

Police officers have a legal obligation to use the least amount of force necessary for any given encounter. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. There are a number of ways that an officer may have used excessive force.

  • Police officers may have caused a suspect to suffer a positional asphyxia by holding them down in a prone position.
  • Police officers may have opened fire on a suspect merely because they were attempting to flee.
  • Police officers may have shot or hit a suspect who was not an immediate threat to anyone.

Many police shootings are highly preventable. They tend to involve officers who are either unwilling or unable to de-escalate encounters. Sadly, though, police departments often do everything in their power to deny responsibility if one of their officers injures or kills a suspect. It is important that these incidents are properly investigated by an outside agency. The family of any person who died in a police shooting may be able to seek some measure of accountability through a civil claim.
