San Diego County officials are saying that the incident took place around 7:00 a.m. on Saturday. The police were responding to a domestic disturbance call about a man allegedly holding a knife.
Officers encountered a man in his 20s standing next to a car. They ordered the man to drop a knife prior to shooting the suspect.
Paramedics were called to the scene in order to help the man. He later died due to his injuries. A full investigation remains ongoing at this time.
Legal Considerations For La Jolla Police Shootings
A large portion of police shootings involve suspects who were in the midst of a mental health crisis. According to the Treatment Advocacy Center, “The risk of being killed while being approached or stopped by law enforcement in the community is 16 times higher for individuals with untreated serious mental illness than for other civilians.” Police officers should take a number of actions if they believe a suspect may be in the midst of a mental health crisis.
- Request backup
- Calm the situation
- Avoid physical contact
- Determine if the suspect is taking medication
- Acknowledge the suspect’s feelings
- Not make any threats
The ability to use lethal force is one of the most consequential powers that police officers hold. It must be used as a last resort. Generally speaking, police officers should only escalate the force that they are using when this is necessary. In far too many situations, police officers will fail to de-escalate encounters. It is crucial that certain steps are taken after any police shooting.
- Eyewitnesses should be interviewed.
- Body camera footage from all officers involved should be reviewed.
- An experienced civil rights attorney should be contacted.
Police shootings are often highly preventable. They tend to involve situations where police officers are unable or unwilling to de-escalate encounters. When police departments investigate themselves, they will inevitably find that their officers did nothing wrong. This is why it is so important that there is an independent investigation after any police shooting. The family of any person who died in a police shooting may have legal recourse through a civil claim.
