pexels-kindel-media-7715238RIVERSIDE, CALIFORNIA (April 10, 2024) –  A man has tragically died in a Riverside police shooting at a home along Chestnut Street not far from Fourth Street.

Riverside County officials are saying that the incident took place around 5:30 a.m. on Thursday. Riverside police officers responded to a domestic disturbance call.

When officers arrived, they said that they encountered a man allegedly armed with a knife. Officers used less-lethal measures before opening fire with their service pistols.

Paramedics were called to the scene, but the man later died due to his injuries.

Liability For Riverside County Police Shootings

California leads the nation in the number of police shootings each year. According to the Public Policy Institute of California, “More than four in ten people treated for non-fatal gunshot wounds from a police encounter were diagnosed with a mental health condition, an alcohol- or substance-related disorder, or both.” Police officers should take a number of measures in order to prevent fatal shootings.

  • Police officers should do their best to de-escalate encounters.
  • Police officers should typically use less-lethal measures before using lethal force.
  • Police officers should work to understand if a suspect may be in the midst of a mental health crisis.

When police officers use excessive force and kill a suspect, this could form the basis of a constitutional claim. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. It is important that certain steps be taken after any police shooting.

  • Body camera footage from all officers involved should be sought.
  • Surveillance footage should be sought.
  • The actions of police officers leading up to the shooting should be understood.
  • An experienced civil rights attorney should be contacted.

Even if a police officer’s actions seemed reasonable in the moment, they may still be excessive depending on what that officer did leading up to the shooting. This is why it is so important that evidence is properly preserved after any police shooting. The family of any person who is killed in a police shooting may be able to seek some measure of justice through a civil claim.
