Legal Considerations for Oak Park Shootings
Gun violence remains all too common across the United States. According to the Pew Research Center, “More Americans died of gun-related injuries in 2021 than in any other year on record, according to the latest available statistics from the Centers for Disease Control and Prevention (CDC). That included record numbers of both gun murders and gun suicides.” There are a number of measures that commercial property owners should take in order to prevent gun violence.
- Property owners should conduct a risk assessment.
- Property owners may need to limit unauthorized entry with locked doors.
- Property owners should install high-quality security cameras.
- Property owners may need to hire security professionals.
All property owners have a legal obligation to protect guests and residents from reasonably foreseeable sources of harm. Pursuant to California Civil Code 1714, “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.” It is important that evidence is properly preserved after any shooting.
- Eyewitnesses should be interviewed.
- A police report should be conducted.
- Surveillance footage should be sought.
- An experienced personal injury attorney should be contacted.
When a property owner has actual or constructive notice about a dangerous condition on their property, they must work to correct the dangerous condition. The level of security measures that a property owner will need to take to protect residents from crimes will vary from one location to the next. Properties in high-crime areas will typically need more security. Properties in low-crime areas may only need minimal security measures.
