Legal Considerations for Tehama County Police Shootings

Thousands of people are harmed every year during encounters with law enforcement. According to the Law Enforcement Epidemiology Project, “In the U.S. during a given year, an estimated 1 million civilians experience police threat of or use of force resulting in a conservative estimate of 75,000 non-fatal injuries requiring hospital treatment and 600-1100 deaths.” There are a number of measures. The police officers should take in order to prevent fatal encounters.

  • Police officers should work to de-escalate any conflicts with suspects.
  • Police officers should use less-lethal options such as tasers.
  • Police departments should have units that specialize in mental health crises.

All police officers have a legal obligation to use the least amount of force necessary to achieve their aims. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. It is important that evidence is properly preserved after any fatal police shooting.

  • Eyewitnesses should be interviewed.
  • Surveillance footage should be sought.
  • Medical records related to the incident should be collected.
  • An experienced civil rights attorney should be contacted.

Many police shootings are highly preventable. They tend to involve officers that are either unwilling or unable to de-escalate encounters. This is particularly true when a police officer engages a suspect who may be under the influence or going through a mental health crisis. It is important for victims of excessive force to understand that they do have rights. The family of any person who died in a fatal police shooting may be able to seek some measure of justice through a civil claim.
