Liability For Los Angeles Police Shootings

Police encounters result in a number of serious injuries and deaths every year. According to the Law Enforcement Epidemiology Project, “In the U.S. during a given year, an estimated 1 million civilians experience police threat of or use of force resulting in a conservative estimate of 75,000 non-fatal injuries requiring hospital treatment and 600-1000 deaths.” A large portion of these shootings involve suspects suffering from a mental health crisis. There are a number of signs that a suspect may be in the midst of a mental health crisis.

  • The suspect may be experiencing hallucinations.
  • The suspect may have incoherent speech.
  • The suspect may be hyper-aggressive.
  • The suspect may show signs of paranoia.

Police officers are given a great deal of discretion in how they perform their job duties. But at no point may a police officer use excessive force. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. Victims of police brutality tend to suffer very serious injuries.

  • Broken bones
  • Head injuries
  • Spinal cord injuries
  • Lacerations
  • Gunshot wounds

Police shootings are often highly preventable. They tend to involve situations where police officers are unwilling or unable to de-escalate encounters. In many situations, officers fail to follow police protocol for dealing with mentally ill suspects. The family of any person who is killed in a police shooting may be able to seek some measure of accountability through a civil claim.
