handcuffsSan Diego  — California Attorney General Rob Bonta has filed felony elder abuse charges against Maria Erolina Delgado, the owner and administrator of J & M Happy Guest Home, a residential care facility for the elderly. The complaint, filed on September 9, accuses Delgado of severe neglect resulting in harm to residents.

Allegations & Facility Conditions

The Division of Medi-Cal Fraud and Elder Abuse (DMFEA) alleges that Delgado maintained the facility under-staffed—leaving residents in soiled diapers for days and bedridden. This neglect led to multiple cases of bed sores, dehydration, and malnourishment.

A criminal complaint filed in San Diego Superior Court has charged Delgado with two felony and two misdemeanor counts of elder abuse involving four residents. The complaint says this abuse took place in 2020.

Legal Framework & Potential Consequences

Elder abuse in California is a serious crime, particularly when perpetrated by caregivers in positions of trust. These felony charges could result in incarceration, fines, and restrictions on professional licensing. Additionally, families impacted by such neglect have grounds to pursue civil claims under elder abuse statutes, including compensation for harm and suffering, such as through civil claims under California Penal Code § 368 and federal elder abuse laws..

Sadly, cases like this are not isolated. Similar investigations and prosecutions—such as a care home in Santa Cruz where negligence led to death—demonstrate a broader pattern of abuse and systemic failures across California’s long-term care settings.
