police gunEscondido – On August 29, 2025, Escondido police were involved in a brief freeway chase and officer involved shooting that ended with 40-year-old Maria Toedt dead.

Incident Details

In the late afternoon, officers pursued Toedt on Interstate 15 near the SR-163 interchange. The chase ended in gunfire around 5:45 p.m. when officers fired, fatally wounding her. Toedt was confirmed to be unarmed.

The investigation is conducted under Assembly Bill 1506 (AB 1506), which mandates state review of any law enforcement shooting resulting in an unarmed civilian’s death. Attorney General Rob Bonta announced the DOJ’s involvement and stated the case will be forwarded to the Special Prosecutions Section upon conclusion of the investigation.

Legal Standards and Public Accountability

Under California Penal Code § 835a, peace officers may use deadly force only if it is necessary to prevent imminent death or serious injury. Investigators will evaluate:

  • Whether the officers reasonably believed a violent threat existed
  • If de-escalation efforts were considered
  • Whether the suspect posed an immediate risk at the time of the shooting

Given the woman was unarmed, finding justification under Penal Code standards will be exceptionally difficult, increasing scrutiny on both departmental policies and officer training.

Seeking Accountability for Officer Involved Shootings

Victims or their families in similar cases have legal avenues available:

  • Civil claims under 42 U.S.C. § 1983 for violations of civil rights, potentially including wrongful death
  • State wrongful death suits under California law, especially when oversight or protocol failures are implicated
