Liability For Crescent City Inmate Deaths

Homicides remain one of the leading causes of inmate injury and death in the United States. According to the Prison Policy Initiative, “Violence in prison is commonplace, tied to trauma prior to incarceration as well as mental health stressors inside. The rate of homicide in state prison is 2.5 times greater than in the U.S. population when adjusted for age, sex, and race/ethnicity.” There are a number of factors that can contribute to violence in a prison setting.

  • Violence is more likely in jails that are overcrowded.
  • Violence is more likely in jails that are understaffed.
  • Violence is more likely to occur when rival gangs are placed in close proximity to one another.

Jails have a legal obligation to protect inmates from reasonably foreseeable sources of harm. This includes attacks at the hands of other inmates. If a jail has specific knowledge of particular threats and fails to protect an inmate, this could form the basis of a constitutional claim. It is important that certain steps be taken after any jail homicide.

  • Jail records related to the attack should be reviewed.
  • Eyewitnesses should be interviewed.
  • The history between the assailant(s) and the victim should be understood.
  • An experienced civil rights attorney should be contacted.

Homicides are typically highly preventable in a jail setting. They are rarely isolated incidents. Instead, they tend to occur at the end of a series of altercations between two or more inmates. Sadly, though, jails will do everything in their power to deny liability if any inmate dies in their care. A civil rights attorney can examine all of the unique facts of your case and let you know what your legal options are.
