SAN FRANCISCO, CALIFORNIA (December 19, 2024) – Five people have reportedly died in the last 13 months while seeking drug rehabilitation in San Francisco.

The findings are part of a deeper dive conducted by the San Francisco Chronicle into Healthright 360. It is the city’s largest publicly funded source for drug rehabilitation.

The deaths have been linked to insufficient staffing, substandard conditions, and also rampant drug use. There have also been reports that safety procedures and policies were not always being followed.

Fentanyl has been particularly devastating. It is a synthetic opioid and 100 times more powerful than morphine.

A full investigation into all of the deaths remains ongoing at this time.

Legal Considerations for San Francisco Drug Rehabilitation Deaths

Millions of people die from preventable drug overdoses every year. Sadly, many of these deaths take place as people are seeking treatment. According to USA Today, “More than 1.4 million people sought treatment for alcohol or drug addiction from inpatient, outpatient and residential treatment programs in 2015, according to the Substance Abuse and Mental Health Services Administration. The federal agency recorded 3,362 deaths.” There are a number of factors that could contribute to any rehab center death.

  • A rehab center may have failed to medically monitor a patient.
  • A rehab facility may have allowed illicit drugs to enter the facility.
  • A rehab center may have neglected to treat a patient with suicidal ideations.
  • A rehab facility may have delayed transferring a patient to a hospital in a timely manner.

Drug rehab facilities have a legal obligation to protect their patients from reasonably foreseeable sources of harm. This requires that they adequately monitor patients and follow all safety procedures. One of the major problems with these rehab centers is that many of the people who work there have no medical training. They don’t always know when a patient is at risk. This can lead to situations where people commit suicide at the facility. It is crucial that evidence is properly preserved after any rehab facility death.

  • Medical records related to the death should be preserved.
  • An independent autopsy may need to be performed.
  • The actions of staff leading up to the death should be understood.
  • An experienced attorney should be contacted.

One of the key advantages of hiring an attorney is that they can take steps to ensure that all relevant evidence related to any death is properly preserved. Deaths at rehab facilities are rarely the result of the wrongful actions of a single person. It is more common that they are the result of systemic failures. This may include instances where rehab centers are understaffed. The family of any person who died at a rehab facility may have legal recourse through a civil claim.
