Liability For Los Angeles County Bus Accidents

Far too many people are seriously injured every year in bus collisions. According to The Journalist’s Resource, “on average, about 63,000 buses [of all kinds] are involved in an accident each year; about 14,000 result in an injured person, and 325 result in a fatal injury.” There are a number of factors that could contribute to any bus accident.

  • Bus accidents tend to occur at intersections.
  • Bus accidents often occur at night and during periods of reduced visibility.
  • Bus accidents could take place when bus drivers are overworked or fatigued.

Buses are considered common carriers, and their drivers are held to a high standard in terms of safety. According to the Judicial Council of California Civil Jury Instructions, “Common carriers must carry passengers [or property] safely. Common carriers must use the highest care and the vigilance of a very cautious person. They must do all that human care, vigilance, and foresight reasonably can do under the circumstances to avoid harm to passengers [or property].” Most bus accidents are preventable.

Many bus accidents are due to bus drivers who are speeding or otherwise violating traffic regulations. There is a rebuttable presumption of negligence on the part of any bus driver who leaves their lane of traffic and collides with a fixed object. It is crucial that certain steps are taken after any Los Angeles County bus accident.

  • Medical records related to the collision should be preserved.
  • Surveillance footage should be sought.
  • Photos of the accident site should be taken.
  • An experienced bus accident attorney should be contacted.

It can be hard to know what to do after a bus accident. Victims are often left with substantial injuries that may require lengthy rehabilitation periods. To make matters worse, bus companies will often do everything in their power to deny responsibility when a passenger is injured in a bus accident. This is why it is so important for victims of bus accidents to seek legal aid as early as possible.
