MOUNT SHASTA, CALIFORNIA (April 23, 2024) – The Mount Shasta Police Department has released body-cam footage of the Amtrak train police shooting that killed Nicholas Detweiler.

Siskiyou County officials are saying that the incident took place on Christmas Day in 2023. Nicholas Detweiler was a passenger on an Amtrak train traveling through Siskiyou County.

Mount Shasta police claim he was acting aggressively. But body camera footage from that day showed that Nicholas Detweiler was sitting alone in a passenger seat and wearing a hooded sweatshirt.

After officers made contact, the passenger got up and appeared startled. A brief conversation was followed by a struggle over a plastic bag.

Following that struggle, a second struggle ensued between the passenger and an Amtrak crew member. An officer pulled out his handgun and shot the passenger six times.

Paramedics were called to the scene in order to help. Despite those efforts, Nicholas Detweiler was later pronounced dead.

GoFundMe to help the victim’s family has been set up by Stamatia Haritoudis.

Liability For Mount Shasta Police Shootings

A disproportionate number of police shootings involve suspects suffering from an untreated mental illness. According to the Treatment Advocacy Center, “The risk of being killed while being approached or stopped by law enforcement in the community is 16 times higher for individuals with untreated serious mental illness than for other civilians.” Police officers should be aware of the potential signs that a suspect may be suffering from a mental illness.

  • A suspect may exhibit disorganized speech or thinking.
  • A suspect may express unusual beliefs or delusions.
  • A suspect may experience hallucinations.
  • A suspect may display disorganized or abnormal behavior.

Police departments are supposed to use the least amount of force possible to meet their goals. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. It is important that certain steps be taken after a police shooting.

  • Body camera footage from all officers involved should be reviewed.
  • Surveillance footage should be sought.
  • The actions of police officers leading up to an encounter should be understood.
  • A thorough investigation should be conducted.

Many police shootings are preventable. They often involve situations where officers are unwilling or unable to de-escalate encounters. It can be hard to know where to begin after any police shooting. To make matters worse, officers will do everything in their power to deny liability for a fatal encounter. This is why it is so important that all evidence related to a shooting is properly preserved and evaluated by a skilled civil rights attorney.
