Her suspected cause of death was listed as an accidental methamphetamine overdose. A full investigation remains ongoing at this time.
Legal Considerations For Los Angeles County Jail Inmate Deaths
Drug overdoses remain a leading cause of inmate death. Los Angeles has had a particularly bad problem with this. According to the Vera Institute of Justice, “In 2018, opioids were involved in nearly 70 percent of all overdose deaths, most of which involved synthetic opioids. Preliminary data for 2019 and 2020 suggest that drug overdose deaths have continued to rise, with synthetic opioids as well as methamphetamine and cocaine being major contributors.” There are a number of signs that an inmate may be going through an overdose.
- Unconsciousness
- Clammy skin
- Seizures
- Chest pain
- Excessive Sweating
All jails have a legal obligation to take care of the health needs of inmates. This must begin when they are first admitted. They should undergo a health screening and be given all medications that they require. If a jail shows deliberate indifference to the serious medical needs of an inmate, this could form the basis of a civil claim. It is important that certain steps are taken after any overdose death.
- The substance involved in the overdose should be identified.
- Medical records should be preserved.
- Jail records should be collected.
- A civil rights attorney should be contacted.
Jail deaths are often highly preventable. This is particularly the case when any inmate dies from an overdose. There could be numerous points of fault for an overdose death. Jails may have failed to prevent drugs from entering inside the jail. Jails may have failed to provide an inmate with Narcan when they were going through an overdose. Jail staff may not have been trained to spot the signs of an overdose. The family of any inmate that died from a drug overdose may have legal recourse through a civil claim.
