Liability For San Mateo County Inmate Deaths

Jails can be very deadly places even in the best of circumstances. According to the Bureau of Justice Statistics, “A total of 4,234 persons died in state and federal prisons in 2019, a 6.6% decrease from the 4,515 deaths in 2018 reported to the Bureau of Justice Statistics’ (BJS) Mortality in Correctional Institutions (MCI, formerly the Deaths in Custody Reporting Program) data collection.”  Many of the inmates that died were never even convicted of the charges they were being held on. There are a number of common causes of inmate death.

  • Cancer
  • Respirator illnesses
  • Septic shock
  • Homicide
  • Suicide

When the state assumes control of a person through incarceration, certain constitutional standards will apply. Inmates must be given healthcare for all of their medical needs. If a jail is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a constitutional claim. Jails should take a number of measures in order to prevent inmate deaths.

  • Jail officials should perform periodic wellness checks on inmates.
  • Jail officials should make sure all inmates have a thorough health screening.
  • Jail officials should listen to the health complaints of the inmates that they are caring for.

It is common for jail officials to ignore the medical requests that inmates make. This can have deadly consequences. For example, an inmate may complain about chest pain but still not be taken to the hospital or be examined by a nurse. That inmate may then suffer from a heart attack. The family of any inmate that died in-custody may have legal recourse through a civil claim. A civil rights attorney can examine all of the unique facts of your case and let you know what your legal options are.
