Liability For Inmate Deaths At Kern Valley State Prison

Homicide remains one of the leading causes of inmate deaths. According to the Bureau of Justice Statistics, “there were 120 homicides of state prisoners during 2018, including homicides committed by other prisoners, incidental to the use of force by staff, and resulting from injuries sustained prior to incarceration.” Jails should take a number of measures in order to prevent inmate homicides.

  • Jail staff should have regular and comprehensive training on conflict resolution and de-escalation techniques.
  • Jails should typically segregate rival gang members away from one another.
  • Jails should do everything in their power to avoid overcrowding. When a jail is overcrowded, inmates will compete for limited resources.

All jails have a legal obligation to protect inmates from reasonable sources of harm. This includes protection from attacks at the hands of other inmates. When jail officials have particular knowledge of specific threats, this must move them to action. There are a number of steps that should be taken after any inmate’s death.

  • Surveillance footage should be sought.
  • An independent autopsy may need to be performed.
  • Jail records related to a homicide should be sought.
  • An experienced civil rights attorney should be contacted.

Homicides are nearly always preventable in a prison setting. They tend to involve prisons with systemic problems. Sadly, though, jails will often do everything in their power to deny liability for any inmate death. It is important that their families seek legal advice after any in-custody death. A civil rights attorney can examine all of the unique facts of your case and let you know what your legal options are.
