Liability For Los Angeles County Inmate Deaths

Los Angeles County has an incredibly poor reputation when it comes to the care that inmates are provided. Many deaths are listed as “natural,” even when this designation can be misleading. According to the Vera Institute of Justice, “when the coroner rules that a death is the result of “natural causes,” jail conditions can still be to blame. Researchers have found evidence of physical harm in more than half of “natural” county jail deaths.” There are a number of common causes of inmate deaths.

  • Heart attacks
  • Excessive force
  • Suicide
  • Respiratory illnesses
  • Inadequate care

All jails have a legal obligation to provide inmates with adequate care for all of their medical conditions. Many inmates enter the jail system with chronic health conditions. Sadly, incarceration tends to make these conditions even worse. When a jail is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a constitutional claim. It is important that evidence is properly preserved after any inmate’s death.

  • Medical records related to the death should be preserved.
  • Autopsy reports should be collected.
  • An independent autopsy may need to be performed.
  • A thorough investigation should be conducted.

It can be hard to know where to begin after an inmate’s death. To make matters worse, jails will often do everything in their power to deny responsibility if someone dies in their care. Jails will claim that many deaths are natural. But a large portion of inmate deaths involve some amount of medical neglect. The family of any person who died in prison may be able to seek some measure of justice through a civil claim.
