Plaintiffs Argue That San Diego’s Juvenile Detention Centers Had Rampant Sexual Abuse
SAN DIEGO, CALIFORNIA (February 20, 2025) – Numerous lawsuits have been filed alleging that San Diego’s Juvenile Detention Centers have allowed rampant sexual abuse to take place.
Six men have come forward and said that they were sexually abused when they were minors staying at the facilities. One plaintiff called the centers a safe place for child predators.
Plaintiffs have described being forced to strip naked and masturbate in front of guards. Others have described being molested by guards.
In total, there have been more than 500 plaintiffs who have said that they’ve been abused in San Diego’s Juvenile Detention Centers.
Legal Considerations for San Diego County Jail Sexual Abuse
Sexual abuse at youth detention centers is unfortunately all too common. According to one report from the Bureau of Justice Statistics, “A higher percentage of male (6.1%) than female (2.9%) youth reported staff sexual misconduct. A higher percentage of female (4.7%) than male (1.6%) youth reported youth-on-youth victimization.” Jails should take a number of measures in order to prevent youth sexual abuse in correctional facilities.
- Jails should thoroughly investigate all allegations of misconduct.
- Jails should perform a thorough background check on all employees at the facility.
- Jail staff should prevent guards from being alone with individual youths.
Jails have a legal obligation to protect inmates from reasonably foreseeable sources of harm. This includes protecting inmates from sexual abuse, which is a known hazard. If jail officials knew (or should have known) that a guard posed a risk to minor inmates and failed to act, this could form the basis of a constitutional claim. It is important that certain steps are taken after any instance of sexual abuse in a youth correctional facility.
- A police report of the incident should be created.
- Eyewitnesses should be interviewed.
- An experienced civil rights attorney should be contacted.
Sexual abuse is often the most destructive and harmful thing that a child can endure. Victims often suffer lifelong psychological injuries, such as post-traumatic stress disorder, anxiety, and depression. They are also much more likely to experience suicidal ideations. It is important for survivors of sexual abuse to understand that they do have legal options. They are able to seek some measure of accountability and justice through a civil claim.
