SANTA ANA, CALIFORNIA (December 20, 2024) – A man has tragically died in a Santa Ana police shooting near the intersection of Broadway and Second Street.
Santa Ana police officials are saying that the incident took place around 5:30 p.m. on Sunday. Officers received reports of a man who was allegedly holding a weapon.
They encountered a man in his 30s in a parking garage. There was some type of altercation followed by a shooting.
Authorities later discovered that the man was holding some type of replica weapon. A full investigation into the police shooting remains ongoing at this time.
Legal Considerations for California Police Shootings
California has one of the highest instances of police shootings. Many of the suspects were unarmed at the time of the shooting. According to the Public Policy Institute of California, “In about 80 percent of encounters resulting in death or a gunshot wound, the civilian was armed with a weapon, underscoring the risky environments officers face. However, when we also consider civilians who sustained other serious injuries, 56 percent were unarmed.” Police departments should take a number of actions in order to reduce police shootings.
- Police officers should be trained to de-escalate encounters.
- Police officers should have less-lethal options, including tasers.
- Police officers should follow protocols when dealing with a mentally ill suspect.
Police officers should only use lethal force as a measure of last resort. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. It is important that evidence is properly preserved after any police shooting.
- Body camera footage from all officers involved should be reviewed.
- Eyewitnesses should be interviewed.
- The actions of police officers prior to the shooting should be understood.
Fatal police shootings are often highly preventable. They tend to involve instances where police officers are unwilling or unable to de-escalate encounters. Sadly, though, police departments will often do everything in their power to deny responsibility if one of their officers kills someone. This is why it is so important that any fatal police shooting is properly examined by a skilled civil rights attorney.
