Liability For Santa Clara County Nursing Home Deaths
Nursing home residents may suffer from all types of abuse and neglect. According to Cureus, “Elder abuse can present in many forms, including physical abuse, psychological/emotional abuse, sexual abuse, financial abuse, and neglect. Many studies estimate that about 10% of all people over the age of 65 experience some form of abuse.” There are a number of measures that nursing homes should take in order to prevent abuse.
- Nursing homes should thoroughly vet all employees.
- Nursing homes should investigate all instances of misconduct.
- Nursing homes should follow all state and federal regulations.
All nursing homes have a legal obligation to take reasonable steps to keep residents safe. They must protect residents from foreseeable sources of harm. This includes protection from assaults against other residents. If a nursing home has evidence to believe that a resident is at risk, they must take action. When a nursing home shows indifference to a safety risk to a resident, this could form the basis of a negligence claim. It is important that certain steps are taken after any nursing home death.
- Eyewitnesses should be interviewed.
- Medical records should be preserved.
- Surveillance footage should be sought.
- A nursing home abuse attorney should be contacted.
Homicides in nursing homes are nearly always preventable. The incidents almost never happen out of the blue. What is far more common is that deadly attacks are followed by a series of smaller incidents. But nursing homes may fail to see the warning signs that an inmate is at risk. The family of a person who died in a nursing home setting may be able to seek some measure of justice through a civil claim.
