Liability For Tracy Police Shootings

Police shootings remain all too common across California and the United States. According to the Washington Post, “The number of fatal police shootings across the country rose again last year, with officers killing 1,096 people, including a 2-year-old girl caught in a standoff. Last year saw the most incidents since The Washington Post started tracking the deaths in its Fatal Force database in 2015, after a police officer killed Michael Brown, an unarmed Black teenager in Ferguson, Mo.” There are many steps that police departments should take in order to prevent police shootings.

  • Police officers should receive training in de-escalation techniques.
  • Police officers should be equipped with non-lethal alternatives.
  • Police officers should follow all guidelines when dealing with mentally ill suspects.

Police officers should always use lethal force as an absolute measure of last resort.  Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. Victims of police brutality tend to suffer very serious injuries including:

  • Head injuries
  • Broken bones
  • Organ damage
  • Gunshot wounds
  • Death

Many police shootings are preventable. They tend to involve officers that do not have a lot of training. Sadly, police departments will often do everything that they can to deny liability for any shooting involving their officers. That is why it is so important that evidence is properly preserved. Evidence will paint a clear picture of what happened regardless of what any officer or department may claim. Any person that is injured in a police shooting may have legal recourse through a civil claim.
