Legal Considerations For Inmate Deaths At San Joaquin County Jail
Inmate deaths remain alarmingly common in the United States. According to the U.S. Department of Justice, “In 2018, a total of 4,135 state prisoners died in publicly or privately operated prisons, and an additional 378 federal prisoners died in facilities operated by the Federal Bureau of Prisons (BOP).” Inmate deaths are often due to systemic errors within a prison system.
- A jail may not have enough trained medical staff.
- A jail may not have Narcan or other lifesaving drugs.
- Jail staff may not be trained to understand when an inmate is in medical distress.
Drug overdoses remain one of the leading causes of inmate death. This is particularly true at a time when powerful synthetic opioids such as fentanyl are flooding the jail system. Jails have a legal obligation to protect inmates from harm brought on by a drug overdose. If a jail is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a constitutional claim. It is important that the circumstances of any death are properly understood.
- The results of any autopsy should be reviewed.
- An independent autopsy may need to be performed.
- Surveillance footage should be sought.
- The actions of jail officials leading up to the death should be understood.
Jail deaths are often highly preventable. This is particularly true when an inmate dies due to a drug overdose. These deaths can be prevented with timely medical intervention. More importantly, jails should work to prevent illicit drugs for entering the jail system. It is important that inmates and their families understand that they do have rights. The family of any person who died in custody may have legal recourse through a civil claim.
