Suspect Arrested After Two Women Died At Assisted Living Facility In Diamond Bar

handcuffs-354042_640DIAMOND BAR, CALIFORNIA (July 13, 2024) – One person has been arrested after two women were found deceased at a senior living facility in Diamond Bar.

Authorities said that the victims were found on Saturday. The suspect has since been identified as a live-in caretaker.

Los Angeles County Sheriff’s Department officials identified the facility as “Happy Home Care For Elderly.” Although no cause of death has been determined, foul play is a suspected factor in the deaths.

Four other residents have been evacuated from the facility. A full investigation into the incident remains ongoing at this time.

Liability For Nursing Home Deaths

Elder abuse and neglect remain all too common in nursing homes. According to the World Health Organization, “Around 1 in 6 people 60 years and older experienced some form of abuse in community settings during the past year. Rates of abuse of older people are high in institutions such as nursing homes and long-term care facilities, with 2 in 3 staff reporting that they have committed abuse in the past year.” Nursing homes should take a number of measures in order to help keep residents safe.

  • Nursing homes should adhere to strict health and hygiene protocols.
  • Nursing homes should maintain adequate staffing levels at all times.
  • Nursing homes should install handrails and non-slip flooring to prevent falls.
  • Nursing homes should have emergency preparedness plans.

All nursing homes have a legal obligation to protect residents from reasonably foreseeable sources of harm. This includes protection from abuse, neglect, and criminal acts. A nursing home could be liable for the death of a resident on the legal theory that a nursing home employee was negligently hired or retained. Several elements must be demonstrated in any negligent retention case.

  • The worker was not fit for their job or otherwise posed an unreasonable risk of danger to nursing home residents.
  • The worker’s employee knew or should have known about the danger.
  • The unfit nature of the worker caused harm to the victim.
  • The negligent hiring or retention of the nursing home employee was a substantial factor in causing harm.

Nursing home deaths and injuries are nearly always preventable. They tend to involve nursing homes with a history of safety lapses. One of the major dangers for residents is living at a nursing home that doesn’t have enough staff to take care of them. The family of any person who dies in a nursing home setting may have legal recourse through a civil claim. A nursing home abuse attorney can examine the unique facts of your case and let you know what your legal options are.
