Oakland Nursing Home Windsor Healthcare Center Facing Lawsuit Over Allegations Related to Rape, Elder Neglect, and Fraud

OAKLAND, CALIFORNIA (July 11, 2024) – A nursing home in East Oakland identified as Windsor Healthcare Center is being sued over allegations of rape, elder neglect, and fraud.

The lawsuit claims that a 79-year-old cognitively impaired woman was sexually assaulted multiple times while staying at the Windsor Healthcare Center.

The plaintiff alleges that his mother was raped by another resident living at the facility. A nurse allegedly knew about the sexual assault but failed to act.

Several days after that first incident, the elderly woman was attacked again. A full investigation into the incident remains ongoing at this time.

Windsor Healthcare Center is one of the largest skilled-nursing home operators in California.

Liability For Sexual Assaults In Nursing Homes

Abuse and neglect remain alarmingly common at nursing homes across California and the United States. According to the Centers for Disease Control, “Abuse, including neglect and exploitation, is experienced by about 1 in 10 older adults who live at home. From 2002 to 2016, more than 643,000 older adults were treated in the emergency department for nonfatal assaults and over 19,000 homicides occurred.” Abuse within nursing homes can take many different forms.

  • Physical Abuse
  • Sexual Abuse
  • Emotional abuse
  • Neglect
  • Financial abuse

Nursing homes have a legal obligation to provide for the wellbeing of all of their residents. They must protect residents from all forms of reasonably foreseeable harm. This includes violent acts by third parties. When a nursing home has actual or constructive notice that a resident is in danger of being assaulted, they must take action. If a nursing home fails to take reasonable action to prevent a nursing home resident from being sexually assaulted, this could form the basis of a negligence claim. It is important that certain steps are taken after any instance of sexual abuse.

  • A police report of the incident should be created.
  • The victim should be moved to a safe location.
  • Eyewitnesses should be interviewed.
  • An experienced nursing home abuse attorney should be contacted.

Sexual abuse is nearly always preventable in a nursing home setting. In order to prevent abuse, nursing home staff should be well-trained. They should understand the factors that lead to sexual victimization and predation. In particular, people with cognitive or physical disabilities are the most at risk of being subjected to sexual abuse. Any person who is sexually abused at a nursing home may be able to seek some measure of justice through a civil claim.
