Liability For Inmate Deaths In Sacramento County
Homicide remains a major cause of inmate death in the United States. According to the Bureau of Justice Statistics, “Ten in 100,000 state prisoners died from homicide in 2018, the highest homicide rate in state prisons since 2001.” Jails should take a number of measures in order to prevent homicide deaths.
- Jails should be well-staffed by trained officials.
- Jails should do everything in their power to prevent overcrowding.
- Jails should typically keep violent inmates away from non-violent offenders.
All jails have a legal obligation to protect inmates from reasonably foreseeable sources of harm. This includes protection from attacks at the hands of other inmates. When jail officials have particular knowledge of specific threats, they must take action. Failure to take action could form the basis of a constitutional claim. It is important that evidence is properly preserved after any inmate’s death.
- Eyewitnesses should be interviewed.
- Medical records should be preserved.
- Surveillance footage should be sought.
- Jail records should be preserved.
Inmate homicides are often highly preventable. They tend to occur in jails that are not particularly well run. This could result in situations where jail officials fail to confiscate weapons or otherwise don’t address the root causes of violence. The family of any inmate who died in custody may be able to seek some measure of justice through a wrongful death claim.
