Liability For Sacramento County Inmate Attacks

Violence remains commonplace in prisons and jails across the United States. According to Statista, “In 2019, 143 inmates of state and federal prisons in the United States were killed by homicide. This is a significant increase from 2008 levels, when 40 inmates were killed in state or federal prisons in the United States.” There are many steps that jails should take in order to prevent inmate assaults.

  • Jail staff should receive training in conflict resolution and de-escalation techniques.
  • Jails should conduct risk assessments on all of the inmates that they care for.
  • Jails should typically keep rival gang members away from each other.
  • Jails should implement and maintain robust security measures.

Depending on the facts of any case, a jail could be liable if an inmate in their care is injured in an attack. When a jail has specific knowledge of particular threats, they must take action to protect the inmate at risk. Failing to take any action in such a circumstance could form the basis of a constitutional claim. Victims of prison attacks tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Organ damage

Jail assaults are rarely ever completely random. Rather, there tends to be signs that an inmate will be attacked. It is important for inmates to understand that they do have rights if they are injured by correctional officers or other inmates. Any person that is assaulted while in custody may be able to seek some measure of justice through a civil claim. A civil rights attorney can examine all of the unique facts of your case and let you know what your legal options are.
