Liability For Pleasant Valley State Prison Inmate Deaths
Jails remain very violent places even in the most ideal settings. According to Statista, “In 2019, 143 inmates of state and federal prisons in the United States were killed by homicide. This is a significant increase from 2008 levels, when 40 inmates were killed in state or federal prisons in the United States.” There are a number of measures that jails should take in order to prevent homicides.
- Jail staff should be well-trained.
- Jails should implement effective risk assessment tools.
- Jails should establish and enhance mental health services within the jail.
- Jails should typically segregate violent inmates away from non-violent offenders.
Jails have a legal obligation to protect inmates from reasonably foreseeable sources of harm. This includes violence at the hands of other inmates. When a jail has specific knowledge of a particular threat against an inmate, they must act. Failing to act in such a circumstance can form the basis of a constitutional claim. It is important that certain steps are taken after any inmate death.
- Eye witnesses should be interviewed.
- The history of interactions between the assailant and the victim should be understood.
- The results of any autopsy should be reviewed.
- An experienced civil rights attorney should be contacted.
Inmate deaths are often highly preventable. This is especially true for any death involving a homicide. Violence within jails is often predictable and much more likely to occur when inmates are not being properly monitored. The family of any person that died in a county jail may be able to seek some measure of justice through a civil claim. A civil rights attorney can examine the unique facts of your case and let you know what your legal options are.
