Santa Barbara – Kayode Agbolade Ogunba was arrested on January 20, 2026 by the Santa Barbara County Sheriff’s Office amidst allegations that he sexually abused residents at a nursing home in Goleta that he worked at as a certified nursing assistant.
Incident Details
According to the sheriff’s office, the investigation on Ogunba began on November 3, 2025, after a care home on South Patterson Road reported that a staff member had sexually abused two residents. Detectives also learned that similar allegations had been made against Ogunba in the Los Angeles area, and that he may have worked as a CNA in other states, including Washington and Texas, in the past seven years.
Following his arrest, Ogunba was booked into the Santa Barbara County Main Jail, where he is being held on $100,000 bail for multiple felony charges, including sexual penetration, lewd or lascivious acts by a caretaker against a dependent person involving force, and elder abuse as well as a misdemeanor count of sexual battery of a dependent adult.
Legal Standards: Protecting Vulnerable Adults
California law treats sexual offenses against seniors and dependent adults with heightened severity. Under Penal Code § 368, both financial exploitation and physical or sexual abuse are felonies—punishable by up to 8 years per count. Additionally, Penal Code § 288(d) imposes consecutive prison terms, underscoring the seriousness of such offenses.
According to data from the National Council on Aging, 1 in 10 Americans aged 60+ report experiencing elder abuse each year. In California alone, nearly 80,000 cases are reported annually—but many incidents remain unreported, especially in caregiving environments.
Advocacy & Legal Remedies
Beyond criminal accountability, survivors and their families may pursue civil action under Civil Code § 51.7 (the Tom Bane Civil Rights Act) and § 52.4 (Elder Abuse Act). These laws enable victims to seek both damages and injunctions, and recovering compensation for medical expenses, pain & suffering, and attorney fees.
