Liability for Los Angeles County Inmate Deaths
Los Angeles County has a very poor reputation for the care that inmates are given. According to the Vera Institute of Justice, “Overcrowded facilities are the most significant single factor driving jail deaths in Los Angeles. The jail system has operated as high as 16.7 percent over capacity since the start of last year.” Several other factors could contribute to an inmate’s death.
- Inadequate healthcare
- Poor sanitation
- Staff misconduct and negligence
- Violence among inmates
All jails have a legal obligation to provide inmates with adequate care for all of their medical conditions. This should begin when an inmate is first admitted. Inmates must receive a thorough health screening. When a jail is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a constitutional claim. Several steps should be taken after any inmate’s death.
- Eyewitnesses should be interviewed.
- Medical records should be preserved.
- An independent autopsy may need to be performed.
- A civil rights attorney should be contacted.
It can be hard to know where to begin after a loved one dies in custody. To make matters worse, jails will often do everything in their power to deny responsibility if someone dies in their care. They may claim that an inmate’s death was due to natural causes. But the fact of the matter is that many jail deaths involve some amount of medical neglect.
