Liability For Los Angeles County Police Shootings
Police shootings remain alarmingly common in California. According to the Public Policy Institute of California, “About 195 people die each year from interactions with California law enforcement. Gunshots are by far the most common cause of death: nearly 250 people are shot by police each year.” Police departments should take a number of measures in order to avoid police shootings.
- Police officers should be trained to de-escalate encounters.
- Police officers should be equipped with less-lethal options, such as tasers.
- Police officers should be trained to understand when a suspect is in the midst of a mental health crisis.
Police officers must do everything in their power to avoid needlessly harming suspects. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. Police officers may have made a number of mistakes in a police shooting.
- Police officers may have shot a suspect after they were subdued.
- Police officers may have shot a suspect who did not pose a danger to anyone.
- Police officers may have failed to follow department protocol.
Police shootings tend to involve suspects who are mentally ill or under the influence of illicit substances. Accordingly, it is essential that police officers follow departmental protocol related to those types of encounters. When an officer fails to follow protocol, this could serve as evidence of negligence. The family of any person who died in a police shooting may have legal recourse through a civil claim.
