The Broader Problem: Sexual Abuse in Elder Care
Sexual abuse against older adults, particularly those in institutional settings, remains alarmingly underreported. Research indicates that these assaults often go unnoticed due to systemic oversight failures, lack of training, and the victims’ reduced capacity to advocate for themselves.
What Families and Communities Should Know
If you suspect abuse in a long-term care facility:
- Immediately report concerns to Adult Protective Services and the Division of Medi-Cal Fraud and Elder Abuse
- Document any evidence, including injuries, unexplained changes in behavior, or missed care
- Seek legal guidance on civil claims for elder abuse or neglect
Civil avenues may include damages under elder abuse statutes or constitutional claims for violation of the right to personal safety and dignity.
