Liability For Los Angeles County Car Accidents

Car accidents remain one of the leading causes of serious injury and death in the United States. According to Forbes, “In the United States, the National Highway Traffic Safety Administration (NHTSA) projects there were an estimated 42,915 traffic fatalities in 2021, a 10.5 percent increase compared to 2020 and the highest annual percentage increase in the Fatality Analysis Reporting System’s history.” There are a number of factors that could contribute to a car accident.

  • Drivers are more likely to crash at higher rates of speed.
  • Drivers are more likely to crash during periods of inclement weather.
  • Drivers are more likely to crash if they are distracted.
  • Drivers are more likely to crash at intersections.

Police departments tend to have a great deal of immunity for vehicle collisions. But the officers involved must have been responding to an actual emergency with their lights and sirens on. When an officer is not responding to an emergency, they must obey the rules of the road as would any other driver. Pursuant to California Vehicle Code 22350, no person shall operate a motor vehicle at a speed greater than would be reasonable or safe given the prevailing conditions of the roadway. Victims of car accidents tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

If a police officer was working at the time of a collision, the department that they were working for could be held at fault. Sadly, though, police departments will often fight hard to deny liability if one of their officers is involved in a collision. Any person that is injured in a car accident with an LAPD patrol vehicle may have legal recourse through a civil claim. A civil rights attorney can examine all of the unique facts of your case and let you know what your legal options are.
