Legal Considerations for Victims and Families

When a person is seriously injured or killed due to gun violence, surviving family members and victims may have legal avenues to pursue justice and accountability. In some cases, if the shooting occurred on a commercial property, property owners may be held liable under premises liability laws if it is determined that they failed to provide adequate security.

Under California Civil Code § 1714, property owners can be held responsible for failing to take reasonable steps to protect patrons and visitors from foreseeable harm. These laws may apply if the location had a history of violence or lacked proper lighting, surveillance, or security personnel.

In fatal shooting cases, families may also be able to bring a wrongful death claim to seek damages for loss of companionship, emotional trauma, and funeral expenses. Each case is unique and requires a thorough investigation to determine potential liability.
